These Beat Licensing Terms ("Licensing Terms") govern the rights and obligations of producers and buyers with respect to beats transacted through the Hasta Haus platform. These Licensing Terms form part of and must be read alongside the Hasta Haus Terms of Service and Privacy Policy.
Every completed auction on Hasta Haus results in a licensing agreement between the Producer and the Buyer. Hasta Haus is not a party to that agreement but provides these standard terms as the framework governing all transactions on the Platform.
These terms are governed by the Copyright Act (Canada) and the laws of British Columbia. Producers and Buyers located in other jurisdictions acknowledge that additional local laws may apply to their use of licensed material.
Producers must designate one of the following license types at the time of listing. The license type cannot be changed once an auction is live.

Upon completing payment for a won auction the Buyer receives:
The license granted is personal to the Buyer and non-transferable. The Buyer may not assign, sublicense, sell, or otherwise transfer the license or any rights thereunder to any third party without express written consent from the Producer.
The Buyer expressly does not receive the following unless agreed separately in writing outside the Platform:
Regardless of the license type sold, the Producer retains the following rights at all times:
Upon sale of an Exclusive License, the Producer loses the right to sell or license the Beat to any other party. The Producer must immediately remove the Beat from any other platform or marketplace where it is listed upon completion of an Exclusive sale on Hasta Haus.
Under the Copyright Act (Canada), producers retain moral rights in their work even after licensing. Moral rights cannot be transferred but may be waived in writing.
By purchasing a Beat on Hasta Haus, the Buyer agrees to:
Producers may choose to waive their moral rights with respect to a specific Beat at the time of listing by indicating this in the listing details. A moral rights waiver applies only to the specific Beat and the specific Buyer of that auction and does not constitute a general waiver of moral rights in any other work.
By listing a Beat on Hasta Haus, the Producer makes the following warranties to both Hasta Haus and the Buyer:
If any of these warranties prove false, the Producer is solely liable for any resulting claims, damages, and costs including reasonable legal fees incurred by the Buyer and Hasta Haus. Hasta Haus bears no liability for sample clearance issues arising from Producer listings.
Buyer's due diligence — while Producers warrant sample clearance, Buyers are encouraged to independently verify clearance status for high-value commercial projects. Hasta Haus does not independently verify sample clearance on listed beats.
Buyers who commercially release a Derivative Work incorporating a Beat are responsible for registering their release correctly with their performing rights organization. The following rules apply:
Hasta Haus recommends that Producers and Buyers establish a written co-publishing or split sheet agreement for any commercially significant release. Hasta Haus does not provide or facilitate split sheet agreements and is not liable for PRO disputes between Producers and Buyers.
For absolute clarity: no auction on Hasta Haus, regardless of price, constitutes a transfer of copyright ownership in the Beat unless a separate, explicit, written copyright assignment agreement is executed between the Producer and Buyer outside of the Platform.
A license, even an exclusive license, is not a copyright assignment. The Producer remains the copyright owner of the Beat in all cases unless they separately and explicitly assign copyright in writing.
If a Producer and Buyer wish to execute a copyright assignment, they must do so through a separate written agreement signed by both parties. Hasta Haus does not facilitate, witness, or guarantee copyright assignment agreements and is not liable for any disputes arising from them.
Buyers who attempt to register the Beat as their own original copyrighted work without a valid written copyright assignment are engaging in copyright fraud under the Copyright Act (Canada) and may be subject to civil and criminal liability.
Buyers are permitted to create Derivative Works using the Beat. This includes:
The following modifications are not permitted without express written consent from the Producer:
Sync rights — the right to use the Beat in timed synchronization with visual media — are determined at the time of listing by the Producer. The sync rights status is displayed on every auction listing before bidding opens.
Full sync rights included — the Buyer receives the right to sync the Beat or any Derivative Work to visual media including film, television, online video, advertisements, video games, and interactive media, without additional payment to the Producer. This right is granted worldwide and in perpetuity as part of the license purchased.
Contact producer for commercial sync — the Buyer's license does not include commercial sync rights by default. The Buyer may use the Beat for non-commercial personal projects but must contact the Producer directly to negotiate a separate sync license for any commercial placement including advertisements, branded content, film, television, and streaming platform productions. Hasta Haus will provide a standard sync contract template to facilitate these negotiations. The terms, pricing, and scope of any sync license are agreed directly between the Producer and Buyer. Hasta Haus is not a party to sync license negotiations and bears no liability for disputes arising from them.
Non-exclusive listings and sync conflicts — Producers who list a Beat as Non-Exclusive and include full sync rights acknowledge that multiple buyers may hold simultaneous sync rights to the same Beat. This may result in competing placements — for example, two different brands using the same Beat in simultaneous advertising campaigns. Hasta Haus bears no liability for conflicts arising from non-exclusive sync placements. Producers who wish to avoid this risk should either list as Exclusive or select "Contact producer for commercial sync."
Sync usage must comply with all other terms of the license purchased, including producer credit requirements under Section 7. For high-value commercial sync placements Hasta Haus recommends using the platform's standard sync contract template to document the agreement between Producer and Buyer.
All licenses granted through Hasta Haus are worldwide in territorial scope unless the Producer explicitly restricts the territory at the time of listing. If no territorial restriction is specified the license is worldwide and perpetual.
Buyers are responsible for ensuring their use of the Beat complies with applicable laws in all territories where the Derivative Work is distributed or performed.
All licenses granted through Hasta Haus are perpetual — they do not expire. The Buyer's right to use the Beat under the terms of the license purchased continues indefinitely regardless of changes to the Platform or the Producer's account status.
In the event that Hasta Haus ceases operations, existing licenses remain valid and enforceable as direct agreements between the Producer and Buyer independent of the Platform.
A license granted through Hasta Haus may be terminated in the following circumstances:
Upon termination the Buyer must immediately cease all use of the Beat and destroy all copies in their possession. Termination does not entitle the Buyer to a refund of amounts paid.
License termination disputes are subject to the dispute resolution process in the Hasta Haus Terms of Service.
If a Buyer discovers that a third party is using the Beat without authorization, the Buyer should notify the Producer directly. Because copyright ownership remains with the Producer, only the Producer has standing to bring a copyright infringement claim under the Copyright Act (Canada) unless copyright has been separately assigned in writing.
If a third party asserts an infringement claim against a Buyer based on the content of the Beat, the Buyer must notify Hasta Haus and the Producer immediately. The Producer is solely responsible for defending against and resolving such claims and for indemnifying the Buyer against any resulting damages, as warranted under Section 8 of these Licensing Terms.
Buyers who purchase a Non-Exclusive License acknowledge and accept that:
Buyers who require exclusivity should only bid on beats listed with an Exclusive License.
Hasta Haus provides these Licensing Terms as a standard framework for transactions on the Platform. Hasta Haus is not a party to any licensing agreement between a Producer and Buyer and assumes no liability for:
Hasta Haus's total liability in connection with any licensing dispute shall not exceed the Platform Fee collected on the relevant transaction.
These Licensing Terms are governed by the Copyright Act (Canada), the laws of the Province of British Columbia, and the federal laws of Canada applicable therein. All licensing disputes not resolved through the Platform's dispute resolution process shall be subject to binding arbitration in Vancouver, British Columbia.
Buyers and Producers located outside Canada acknowledge that Canadian law governs these Licensing Terms regardless of their jurisdiction and consent to this governing law as a condition of using the Platform.
Hasta Haus reserves the right to update these Licensing Terms. Updated terms apply to auctions listed after the effective date of the update. Completed transactions are governed by the Licensing Terms in effect at the time of auction close and are not retroactively affected by updates.
Registered users will be notified of material changes by email at least 14 days before the effective date.
